29 CFR 1926.20(b)(2): Safety programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: a. On or about June 5, 2012, at the above addressed jobsite, safety inspections were not made by persons capable of identifying and correcting hazards, such as roof falls, which would assure compliance with the company's safety program.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about June 5, 2012, at the above addressed jobsite, employees working from the 10/12 pitched roof were exposed to falls of approximately 10 feet due to the lack of fall protection.
