29 CFR 1926.100(a):   Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:      a)  Worksite, Exterior of home - Employees were not wearing protective helmets and were exposed to being struck by asphalt shingles and tools while walking and working below overhead work; on or about 06/07/12.        Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Exterior, Garage Roof - Employees were installing asphalt shingles on the garage of a two story residential home.  The employees were not protected from falling approximately 10ft to the ground below; on or about 06/07/12.    b)  Exterior, Front Portico - Employees were installing asphalt shingles on the portico roof of a two story residential home.  The employees were not protected from falling approximately 12ft to the ground below;  on or about 06/07/12.    c)  Exterior, Main Roof - Employee was installing asphalt shingles on the main roof of a two story residential home.  The employee was not protected from falling approximately 25ft to the ground below; on or about 06/07/12.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1):   Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:      a)  Worksite, front of home - Employees were using an extension ladder to access the roof of the home.  The ladder was extended approximately 1 1/2ft above the landing; on or about 06/07/12.        Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
