29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a) Roof area above garage entrance at front of the site: On June 6, 2012, an employee accessed a 6 in 12 pitch roof structure to paint the window frames without a means of fall protection and was exposed to an approximate 10 foot fall hazard.     Note: Abatement certification IS NOT required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    a) All exterior areas of the residential site: On June 6, 2012, and times prior thereto, employees performing exterior painting from elevated levels had not been provided with training and/or instruction regarding the need/use of fall protection systems.      Note: Abatement certification IS required for this item.
