OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:    On or about June 8, 2012, at the polishing room/sanding area, where the employer did not furnish appropriate piping used to transport compressed air exposing employees working in the area to the hazard of being struck by plastic shards in the event of pipe failure.

29 CFR 1910.133(a)(1):     The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)(LOCATION)(IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)(DESCRIBE HAZARD(S) WHERE NECESSARY)    Instance a:  On or about June 8, 2012, at the paint booth, where the employer did not ensure that affected employees required to wear safety spectacles with unperforated sideshields when exposed to eye hazards from liquid chemicals including but not limited to Toluene, Methyl Ethyl Ketone, Acetone were wearing them. This created a condition which exposed employee(s) to the hazard(s) of eye irritation.    Instance b:  On or about June 8, 2012, at the polishing room/sanding department, where the employer did not ensure that affected employees required to wear safety spectacles with unperforated sideshields while sanding and polishing wood cabinetry components were protected from flying wood and silica dust particles . This created a condition which exposed employee(s) to the hazard(s) of eye irritation.
