29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems: (a) On or about March 19, 2012, an employee working on a pump jack scaffold between 10 and 16 feet above the ground was not protected from falls with guardrails or by being tied off. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest system, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: (a) On or about March 19, 2012, employees were not trained in the installation and operation of the personal fall arest system installed for use while working from the scaffold in that the rope-grab on the vertical lifeline was installed upside-down.
