29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. Employees operating a Toyota forklift were exposed to struck by hazards in that an examination of the forklift was not done prior to each use.

29 CFR 1910.303(g)(1): Space about electric equipment. Sufficient access and working space shall be provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment. On the East wall, the Electrical Breaker Panel box was blocked with a black cylinder tank approximately 5 feet in height, 3 feet in diameter and a 5 gallon container holding scrape material.
