29 CFR 1910.151(a):     The employer did not ensure the ready availability of medical personnel for advice and consultation on matters of plant health.    On or about 7 June 2012, an employee at the work site presented signs and symptoms of a heart attack or heat stress. The employer did not ensure the availability of medical personnel for advice and consultation for matters of plant health, specifically the ability to recognize the signs and symptoms of a heart attack.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the on site medical response plan provides for effective and immediate first aid care and ready availability of medical personnel.

29 CFR 1904.29(b)(1):     A Log of all recordable work-related injuries and illnesses (OSHA Form 300 or equivalent) was not completed in the detail as required by the regulation.    At the inspection site, for calendar years 2009 through 2011, various errors and inconsistencies on the OSHA Form 300 Log materially impaired understandability of the nature of hazards, injuries and illnesses in the workplace.    a) For calendar year 2009, case# 400476 did not specify the object or substance that directly injured or made the person ill, and the injury column (M) had both Injury (M1) and All other illnesses (M6) checked when the instructions state to check one. Case# 396414 did not specify the object or substance that directly injured or made the person ill, or the injury. Also, the case was missing the classification (cloumns G through J). And the page totals at the bottom were not filled in.    b) For calendar year 2010, case# 56442 was missing the location of the event (column E). All four (4) cases were missing either the injury or illness, the parts of body affected, or the object or substance that directly injured or made the person ill in column F. Also, columns M1 through M6 were not completed for cases# 55880 and 56442.    c) For calendar year 2011, all seven (7) cases were missing either the injury or illness, the parts of body affected, or the object or substance that directly injured or made the person ill in column F. Also, the page total for On job transfer or restriction (column L) had 4 instead of 135 (should be total of days and not cases).    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the OSHA 300 Log is being filled out completely and accurately.

29 CFR 1904.29(b)(2):     The employer did not complete an OSHA 301 Incident Report form, or an equivalent form, for each recordable injury or illness entered on the OSHA 300 Log.    At the inspection site, for calendar years 2009 through 2011, the OSHA 301 Incident Reports or substitute forms were incomplete and not maintained at the detail required by the regulation for each case on the OSHA 300 Logs.    a) For calendar year 2009, case# 396414 did not have an incident report completed. Also, case# 400476 states that medical treatment was declined in line 6, even though it was recorded on the OSHA 300 Log. And case# 40476 is missing information for line 17, what object or substance directly harmed the employee.    b) For calendar year 2010, cases# 53473, 55778, and 55880 are missing information for lines 7 (where was treatment given) and 17 (what object or substance directly harmed the employee). Case# 56442 was missing information for line 17 (what object or substance directly harmed the employee).    c) For calendar year 2011, cases# 1599241, 156221, 1609751, and 1676431 are missing information in various lines of the form. Case# 1599241 is dated 5/25/2011 even though the Log shows the date as 8/23/2011. Also, the case recorded on 11/3/2011 is missing a case#.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the OSHA 301 or equivalent forms are complete and accurate.

At the inspection site, for calendar years 2010 and 2011, the OSHA 301 Incident Report or equivalent form was not completed within 7 calendar days of the date of injury or illness for recordable incidents.    a) For calendar year 2010, case# 56442 did not have the date of completion for the form filled in.    b) For calendar year 2011, case# 1609751 did not have the date of completion for the form filled in.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the OSHA 301 Incident Report or equivalent form is completed within 7 calendar days of a reported and recordable injury or illness.

At the inspection site, for calendar year 2009, the Summary of Work-Related Injuries and Illnesses, OSHA Form 300A, lacked the totals from the OSHA 300 Log for entries G through M6. All of the entries or lines were blank while the Log had two recordable cases, and should have reflected on the Summary.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the OSHA 300A Summary is complete and accurate.
