29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)  jobsite, 1121 French Street in Erie, PA.  On or about June 8, 2012, subcontractors employees were on a tubular welded frame scaffold performing stucco operations and related work.  Employees of the subcontractor who were working on the scaffolds lower platforms and on the ground were not wearing hard hats to protect them from being struck by tools, materials or equipment falling from the scaffold.

29 CFR 1926.451(g)(1):     Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    )  jobsite at 1121 French Street in Erie, PA.  On or about June 8, 2012, subcontractors employees were on a tubular welded frame scaffold performing stucco operations and related work.  Employees of the subcontractor were not protected from falling 20 feet to the lower level while working on the scaffold. Personnel were not protected from falling by properly erected standard railings and/or personal fall arrest systems.

29 CFR 1926.20(b)(2):     The employer did not initiate and maintain such accident prevention programs that provide for frequent and regular inspections of jobsites, materials, and equipment to be made by competent persons designated by the employer:    a)  construction site, 1121 French Street in Erie, PA.  On or about June 8, 2012, and times prior thereto, Bruin Construction Services did not maintain accident prevention programs which would provide for frequent and regular inspections of the jobsite, materials and equipment nor did the employer designate a competent person to conduct such inspections.
