29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Located at 2 9th Avenue/Little West 12th Street, New York, NY On or about 6/8/2012 a) Employees working on a building canopy conducting building facade repairs used a portable ladder to access teh canopy and the ladder was not extended at least 3 feet above the landing surface being accessed. Ladder was leaning on the side of the building and employees step off side to access the canopy.
