OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees entering confined spaces such as, but not limited to, concrete culverts were not protected from atmospheric contaminants including hydrogen sulfide and/or methane, oxygen deficiency, and engulfment. On or about June 11, 2012, and at times prior thereto at a workplace located at Precinct Line Road and 183 Airport Freeway, Hurst, Texas; employees were required to enter concrete culverts that had not been evaluated to determine if they were permit or non-permit required confined space to set grading lasers and clean out debris. Prior to entry, the culverts were not evaluated to assure acceptable atmospheric conditions exposing employees to the hazards of hydrogen sulfide and /or oxygen deficient conditions.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: on or about June 11, 2012, and at times prior thereto at a workplace located at Precinct Line Road and 183 Airport Freeway, Hurst, Texas; employees were not provided a safe means of egress from a 7-foot 9-inch deep excavation. At least one employee was observed climbing up the 35 degree slope between the west side of the culvert and the earthen wall to exit the excavation.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): on or about June 11, 2012, and at times prior thereto at a workplace located at Precinct Line Road and 183 Airport Freeway, Hurst, Texas; employees who were working in a 9 foot deep vertical wall excavation that was not benched, sloped or shored, were exposed to the hazards of a cave-in.
