OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees entering confined spaces such as, but not limited to, concrete culverts were not protected from atmospheric contaminants including hydrogen sulfide and/or methane, oxygen deficiency, and engulfment.        On or about June 11, 2012, and at times prior thereto at a workplace located at Precinct Line Road and 183 Airport Freeway, Hurst, Texas; employees were required to enter concrete culverts that had not been evaluated to determine if they were permit or non-permit required confined space to set grading lasers and clean out debris. Prior to entry, the culverts were not evaluated to assure acceptable atmospheric conditions exposing employees to the hazards of hydrogen sulfide and /or oxygen deficient conditions.
