29 CFR 1926.501(b)(13): 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a) Main roof structure: On June 1, 2012 and at times prior thereto, an employee was exposed to a 9 foot fall hazard while performing framing activities on a 5 in 12 pitched roof without a fall protection system in place.     Note) Abatement certification is NOT required for this item

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:     a) Main roof area: On June 1, 2012 and at times prior thereto, an employee did not acknowledge the hazard of performing framing activities on a sheathed roof without a fall protection system in place, and take appropriate action to eliminate or minimize the hazard.    Note) Abatement certification IS required for this item.
