29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. On or about June 12, 2012, the employer did not record the following workplace injuries or illnesses on the OSHA Form 300 or equivalent for the calendar year 2012. a. On May 15, 2012, an employee sustained checmical burns on the tops of both feet requiring a prescription burn ointment and a job transfer. The inury was not recorded on the OSHA Form 300. b. On May 22, 2012, an employee was treated for a chemical exposure from inhalation requiring a prescription and a job transfer. The injury was not recorded on the OSHA Form 300.

29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet: On or about June 12, 2012, the employer did not create a chemical inventory list of the chemicals known to be present in the facility. Employees are exposed to chemicals such as, but not limited to, LESCO Three-Way Selective Herbicide.
