29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    The employer does not protect employees from falling when working 6 feet or more above lower levels.  This violation was observed on or about June 11, 2012, at the construction site where employees were exposed to a fall hazard when working at a height of approximately 10 feet without a personal fall arrest system.    Vera Jose Antonio was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 315675181, Citation Number 1, Item Number 1 and was affirmed as a final order on 9/21/2011, with respect to a workplace located at 23547 Legacy Oak St., Katy, Texas 77493.
