29 CFR 1910.23(e)(1):     A standard railing shall consist of top rail, intermediate rail, and posts, and shall have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The top rail shall be smooth-surfaced throughout the length of the railing. The intermediate rail shall be approximately halfway between the top rail and the floor, platform, runway, or ramp. The ends of the rails shall not overhang the terminal posts except where such overhang does not constitute a projection hazard.    The employer is failing to protect employees from potential fall hazards associated with inadequate guard rails installed along foyers and stairwells where the walking surface is greater than 4 from the working level below.  This was most recently evident during the inspection of the facility located at 10401 Hwy 6, Lincoln, NE 68517, where the employer has employees using the staircase near the main entrance to access the second floor and the guard railing currently installed measures 34 from floor to top rail and the drop to the first floor is more than 16.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    The employer failed to protect employees from potential struck by hazards associated with operating a forklift without performing a pre-operation daily inspection.  This was most recently evident during the inspection of the facility located at 10401 Hwy 6, Lincoln, NE 68517, where the employer has employees using the V. Mariotti Model MYCROS 10C to move materials throughout the facility without having conducted pre-operation inspections.
