29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i). On or about June 13, 2012 employees were working in a trench measured at 6.8 feet in depth without cave in protection, exposing employees to the hazards associated with a trench collapse. THE KELLENBERGER PLUMBING AND HEATING, INC. DBA KELLENBERGER PLUMBING & UNDERGROUND CONSTRUCTION, WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311028997, CITATION NUMBER 1, ITEM NUMBER 3A AND WAS AFFIRMED AS A FINAL ORDER ON JULY 12, 2007 WITH RESPECT TO A WORKPLACE LOCATED AT 1267 North Ave, Palatine, IL 60067. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
