29 CFR 1926.602(b)(9)(ii): The employer permitted earthmoving or compacting equipment which had an obstructed view to the rear to be used in reverse gear when the equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level, or an employee signals that it is safe to do so:    a) Road project: On June 5, 2012 and at times prior thereto the Ingersoll Rand asphalt rollers #438 and #439 did not have serviceable back-up alarms.      b) Road project: On June 5, 2012 and at times prior thereto the back-up alarm on the Ingersoll Rand asphalt roller #427 was barely audible, and then continued to alarm when the equipment was turn off.     c) Road project: On June 5, 2012 and at times prior thereto the Cat backhoe, #450 did not have a serviceable back-up alarm.        Note) Abatement certification IS required for this item.
