29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical in use:    (a)  At the project on or about June 11, 2012, and at times prior thereto, there was no material safety data sheet(s) for Quikrete Commercial Grade, Type I/II Portland cement. Employee applied the product onto existing concrete ceilings and walls.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.    (a)  On June 11, 2012, or at times prior thereto, the controlling and exposing employer BME & Sons, failed to ensure the use of appropriate gloves while mixing and applying Portland cement.  The Portland cement was mixed with water in a five gallon bucket and applied onto existing concrete ceilings and walls.  The exposed employee was observed handling/applying Portland cement with his bare hands.
