29 CFR 1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used: (a) At 32 West Main St Millbury, MA: On or about May 25, 2012, an employee was observed climbing out a second story window to access a carpenters bracket scaffold platform which was 3.8 feet above the window sill he climbed out. The scaffold platform was in excess of 25 feet above ground level. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level: (a) At 32 West Main St Millbury, MA: On or about May 25, 2012, an employee was observed working from a carpenters bracket scaffold at both the front and rear of the structure which were in excess of 19 and 25 feet, respectively, above the ground below with no fall protection in either location/case as required by this subpart. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
