29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives. a) On or about and at times prior to June 13, 2012, the employer did not develop and implement a written site specific permit-required confined space program for employees who worked in permit-required space of the three manholes. OR IN THE ALTERNATIVE 5A1: All employees required to enter into confined or enclosed spaces shall be instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required. The employer shall comply with any specific regulations that apply to work in dangerous or potentially dangerous areas. a) On or about and at times prior to June 13, 2012, the employer did not develop and implement a permit-required confined space program that would instruct employees of permit-required space hazards, precautions to take to avoid hazards, or the use of protective and emergency equipment in the three manholes. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
