29 CFR 1910.23(a)(5):     Every pit and trapdoor floor opening, infrequently used, shall be guarded by a floor opening cover of standard strength and construction. While the cover is not in place, the pit or trap opening shall be constantly attended by someone or shall be protected on all exposed sides by removable standard railings.    a) In the Clean Room, on or about and at time prior to June 13, 2012, the employer did not guard the drain pit exposing employees to slip and fall hazards.

29 CFR 1910.145(c)(3):     Safety instruction signs. Safety instruction signs shall be used where there is a need for general instructions and suggestions relative to safety measures.    a)  Outside incinerator area, on or about and at time prior to June 13, 2012, portable 330-gallon LP-gas tanks did  not display warning signs such as, but not limited to, "No Smoking", thus exposing employees to fire hazard.

29 CFR 1910.146(c)(4):     If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives.    a)  On or about and at times prior to June 13, 2012, the employer did not develop and implement a written site specific permit-required confined space program for employees who worked in permit-required space of the three manholes.    OR IN THE ALTERNATIVE    5A1:  All employees required to enter into confined or enclosed spaces shall be instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required.  The  employer shall comply with any specific regulations that apply to work in dangerous or potentially dangerous areas.    a)  On or about and at times prior to June 13, 2012, the employer did not develop and implement a permit-required confined space program that would instruct employees of permit-required space hazards,  precautions to take to avoid hazards, or the use of protective and emergency equipment in the three manholes.         ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.

The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    a)  In the Hatchery Area - On or about and at times prior to June 13, 2012, the employer did not ensure an effective lock-out or tag-out program was developed to explain procedures for authorized and affected employees, as a result emplooyees were exposed to electrical and shock hazard.

29 CFR 1910.1200(g)(8):       The employer did not ensure that Safety Data Sheets were readily accessible during each work shift to employees when they were in their work area(s)    a)  At the facility, on or about and at time prior to June 13, 2012, Material Safety Data sheets of chemicals such as  but not limited to Sodium Hypochlorite, BioSentry 904 Disinfectant were not readily accessible to early morning and night   employees.      ABATEMENT CERTIFICATION IS REQUIRED.
