29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: The employer does not ensure that seatbelt is worn when operating an excavator. This violation was observed on or about June 11, 2012, on the construction site during a land preparation operation where employees were exposed to an ejection hazard when operating the Caterpillar excavator, model 801.8C without donning the seatbelt.
