29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder: a) Goodwill Industries of North Central PA, Bradford store. On or about June 13, 2012, and times prior thereto, a wooden platform was used by employees to access the dumpster behind the building. The open sides of the platform, 4 feet, 2 inches above the ground, were not guarded by a standard railing to protect employees from falling. b) Goodwill Industries of North Central PA, Bradford store. On or about June 13, 2012, and times prior thereto, the concrete embankment next to the dumpster was not guarded by a standard guardrail to protect employees from falling 14.5 feet in to the Tunungwant Creek.

On or about June 13, 2012, and times prior thereto, the wooden stairway with 8 risers was used by employees to access the dumpster behind the building. The stairway did not have a standard railing in that, the stair railing did not consist of an intermediate rail.
