29 CFR 1926.20(b)(1):     It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    a.     On the site where a dairy barn was being consructed, the employer did not develop and maintain a Site Specific Acident Prevention Pogram for employees on the site thereby exposin them to fall and struck-by hazards.

29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    a.     On the site where employees were building a new daiy barn, regular an frequent inspections were not performed to identify hazards relating to falls, impalement hazards, electrica hazards and lack of personnel protection equipment thereby exposing employees to a fall/contact hazard.

29 CFR 1926.501(b)(1):     "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a.     On th roof of the dairy barn being built,the general contractor did not ensure the employees of Martin Wickey were provided and enforced to wear fall protection thereby exposing employees to a 35 foot fall hazard. One employee working on the roof installing weather straps lost his balence and fell to the concrete floor below. The employee was not wearing fall protection.

29 CFR 1926.503(a)(1):     The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a.     On the site where employees worked at heights which exceeded six  feet, the employer did not provide fll protection training for employees who were required to ensure fall protection was used properly and the policy enforced.
