29 CFR 1926.652(a)(1): Each employee in an excavationwas not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): The employer does not protect its employees from cave-ins while working in a trench. This violation was observed on or about June 13, 2012, at the job-site on the Southeast corner of FM 2920 and Stuebner Airline Road where employees were exposed to a struck-by hazard when working inside of a trench excavation without an adequate protective system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an adequate protective system is available for employees to use while in a trench.
