OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  that employees were exposed to struck-by and crush hazards:    a)  At Marbury Steel Fabricators:  On or about June 13, 2012 and at times prior; the employer failed to require and enforce the use of seatbelts for all employees operating forklifts on site exposing them to struck-by and crush hazards from being thrown from the lift.

29 CFR 1910.178(p)(1):     Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition:    a)  At Marbury Steel Fabricators:  On or about June 13, 2012 and at times prior; the employer failed to take a Master Craft Forklift out of service for repairs to include but not limited to a non working horn exposing employees to struck-by hazards.

29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a)  At Fabrication Shop:  On or about June 13, 2012 and at times prior; the employer failed to ensure the guard on a cold saw was working properly exposing employees to amputation hazards.
