29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    a. Where a half mask, negative pressure cartridge respirator was used for spray painting solvent based paints and components, a medical evaluation was not provided to the painter.    Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).

Where a half mask, negative pressure cartridge respirator was used for exposure to chemical products, fit testing was not provided to all users.    Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. 29 CFR 1910.1200(h):     Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced in their work area:    a. Where various solvent based and other hazardous chemical products were used for spray painting, body work, and cleaning vehicles, chemical hazard communication training was not provided, including on the physical (fire hazard) and health hazards of the products used, making material safety data sheets available for all chemical products, including organized in a manner to make them readily available, ensure labeling, and training for safe use, including for proper ventilation and reducing fire hazards.    Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).
