29 CFR 1910.119(d)(3)(i)(B): The employer's piping and instrument diagrams (P&ID's) were not accurate and did not represent equipment that was existing and was part of the process.     On or about June 14, 2012 and at times prior thereto, the employer did not ensure that the P&ID's were current and up to date, including but not limited to:       a) In the isopropyl alcohol unloading port, a y-strainer filter on or about April 22, 2007, was not identified on the P&ID, IPA  drawing # 0401.      b) In the isopropyl alcohol feed filter area, a dp indicator, installed on on or about December 12, 2006 was not indiacted on the P&ID, IPA Drawing # 0401.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices (REGAGEP).      On or about June 14, 2012, and at times prior thereto, the employer did not ensure that the Anhydrous Ammonia (aNH3) and Isopropyl Alcohol (IPA) systems complied with recognized and general accepted good engineering practices according to national and industry consensus codes, standards and recommended practices such as but not limited to the following:        a) In the 1st floor ammonia scrubber area, the scrubber circulation pump (P-0303) was not labeled or identified.        b) In the 1st floor ammonia scrubber area, the 1: pipe (NH4OH-3104-TL4A) from the D-0303 aNH3 Scrubber to the V-3336 valve was not labeled with its identity, physical state, relative pressure and direction of flow.       c) In the 2nd floor IPA evaporator area, cetain valves were not labeled or identified.

On or about June 14, 2012, and at times prior thereto, the employer did not establish written procedures or clear procedures, such as but not limited to:    a) Unloading of Anhydrous Ammonia  b) In the Anhydrous Ammonia unloading building, the employers supervisor overrides the ammonia monitoring system as a matter of practice, disabling the ammonia alarms, each time during the unloading process.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:     On or about June 14, 2012, and at times prior thereto, the employer did not provide posted danger signs or take effective measures to prevent employees from entering in to permit-confined spaces.  Employees were exposed to asphyxiation and other fire and chemical hazards.  A sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.    In the outside IPA storage tank area, tank T0405B did not have a label to warn employees of the confined space hazard and the opened space was not guarded to prevent unauthorized entry.
