Employees were exposed to hazards caused by inexperienced forklift truck operator.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: On or about May 23, 2012, employees were observed working from a wood pallet platform attached to a forklift truck and elevated to a height more than 10 feet high. The wood pallet platform was observed not secured to the forklift truck. Employees were exposed to fall hazards.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On or about May 23, 2012, at the jobsite an employee was observed working from a wood pallet platform which was mounted onto an all-terrain forklift truck and raised to a height over 10 feet high. The employer did not have a written approval from the forklift truck manufacturer to allow such addition/modification to the forklift. The employees were exposed to fall and struck by hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about May 23, 2012, at the job site an employee was observed installing a gutter on top a roof of a building more than 10 feet high to the ground. The employee was not wearing personal fall arrest system or having any other type of fall protection systems provided. The employee was exposed to fall hazards.
