OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards and/or death while operating riding lawn mowers. WORKSITE: The employees, required to operate an Ex-mark model LZZ29KA606, 60 inch, series 6 Ultra cut riding lawn mower, serial number 790720 were not given specific instructions and training in workplace related topics particularly dealing with the ground conditions where the mower would be operated; inclines, and/or other sloped surfaces that could affect the stability of the mower. On or about June 6, 2012, the employee, operating the above mower to cut grass on and around the side of a sloped hill when the mower slide down the hill and rolled over, pinning the operator underneath. The operator sustained severe fractures and crushing injuries to his right forearm, wrist and hand from the incident.
