OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment that were free from recognized hazards that could cause death or serious physical harm to employees in that employer did not follow the manufacturer's specific torqueing maintenance recommendations for the Versalift Model V0255, manufactured by Time Manufacturing Company.: ABATEMENT NOTE: Among other procedures, one feasible and acceptable abatement method to correct the hazard is for the employer to follow the manufacturer's Service and Installation Manual for the Versalift VO-255 aerial device, dated 08/05. The manual states on page 4-4 under heading SIX MONTH OR 500 HOURS MAINTENANCE AND INSPECTION, Section 2, Paragraph E, "All load supporting bolts (rotation bearing bolts. pedestal/subframe mounting bolts, and platform rotator mounting bolts) must be physically retorqued to the specifications included on the torque chart in this section." All other critical fasteners must be visually inspected for tightness and signs of failure. If any loose fasteners are found both the nut and bolt must be replaced and tightened to the proper torque. Also on page 4-11 of the same manual for MAINTENANCE AND INSPECTION CHECKLIST AND RECORD, under the Every 6 months Check or 500 hrs, part 2E states"Retorque Load supporting bolts/visually inspect Critical Fasteners." The employer is responsible for selecting and carrying out an appropriate abatement method.
