29 CFR 1926.760(a)(1) Each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: (a) Independent Roofing, LLC at 2015 Market St. in Denver, CO: On June 15, 2012 employees engaged in steel erection activities were not protected from fall hazards in that two employees plumbing a column were working at an unprotected edge on the East side of a second story flat roof without fall protection. This condition exposed the employees to a fall hazard of approximately 22 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(4) Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers: (a) Independent Roofing, LLC at 2015 Market St. in Denver, CO: On June 15, 2012 employees were not protected from tripping or stepping through holes in the roof. Two employees were working on the roof which had six uncovered holes. This condition exposed the employees to a fall hazard of approximately 22 feet. 29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) Independent Welding, LLC at 2015 Market St. in Denver, CO: On and beforeJune 15, 2012, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Two employees were working next to the edge of the roof on a two-story commercial building without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 22 feet to the ground below. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. 29 CFR 1926.351(e) Whenever practicable, all arc welding and cutting operations were not shielded by noncombustible or flameproof screens to protect employees and other persons working in the vicinity from the direct rays of the arc: (a) Independent Welding, LLC at 2015 Market St. in Denver, CO: On June 15, 2012 welding and cutting operations were not shielded by noncombustible flameproof screens. Two welders were working on the South East end of the commercial property without screens when other workers were nearby. This conditoin exposed employees to an eye hazard. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
