OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in which an employee was expsoed to falling while standing on a wooden pallet that was elevated on the forks of a Lull. (a) Location - 203 Littleton Road, Westford, MA: On or about 6/16/2012, an employee was standing on a pallet that was elevated on the forks of a Lull. Among other feasible and acceptable methods to correct these hazards is to ensure that the operator and employees follow the Lull owner/operator manual and utlize an approved platform to elevate employees.

29 CFR 1910.178(m)(5)(ii): A powered industrial truck is unattended when the operator is 25 ft. or more away from the vehicle which remains in his view, or whenever the operator leaves the vehicle and it is not in his view. (a) Location - 203 Littleton Road, Westford, MA: On or about 6/16/2012, an employee was standing on a pallet that was elevated on the forks of a Lull. The operator had elevated the employee and material and walked away from the Lull leaving it unattended.
