29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a) Directly above the garage: On June 12, 2012, and times prior thereto an employee was observed installing roof jacks for the ventilation fans on a 6 in 12 pitch residential structure without any means of fall protection and exposed to a 32 foot fall hazard.     Note) Abatement certification IS NOT required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    a) Establishment wide: On June 12, 2012, and times prior thereto, an employee exposed to fall hazards while involved in installing ventilation equipment on a roof structure demonstrated the inability to recognize the potential hazards and was unable to identify what procedures and/or actions to take in order to minimize the risk an/or eliminate these hazards.
