29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and fuardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. a) Tri State Professional Contractors Three employees were conducting roofing work on a 3.9 inch 12 pitch low slope roof at heights no less than 10'6" above grade without any means of fall protection on or about June 8, 2012. No abatement certification or documentation required.

29 CFR 1926.503(a)(2)(viii): The employer did not assure that each employee had been trained by a competent person qualified in the standards contained in subpart M. a) Tri State Professional Contractors - Three employees were conducting roofing work on a 3.9 inch 12 pitch low slope roof at heights no less than 10'6" above grade and were not trained by a competent person to recognize potential fall hazards and how to mitigate those hazards on or about June 8, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
