29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    WORKSITE: The employee authorized and allowed to operate the Lull Highlander model 644B-37 rough terrain forklift, had not received training in the safe operation of the powered industrial truck.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.    WORKSITE: The Lull Highlander model 644B-37 rough terrain forklift, not designed by the manufacturer to support scaffold platforms, was used to elevate and support a pallet/ platform while an employee was laying concrete block approximately 17 feet above the ground.

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.    WORKSITE: The scaffold platform from which an employee, laying concrete block approximately 17 feet above the ground was not secured to the forks of the Lull Highlander model 644B-37 rough terrain forklift truck.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    WORKSITE: The employee laying concrete block from an elevated work platform, 17 feet above the ground was not protected from falling by use of personal fall arrest and/or guardrail systems.

29 CFR 1926.602(c)(1)(vi): All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.    WORKSITE: The operator of the Lull Highlander model 644B-37 rough terrain forklift truck was not positioned at or near the controller of the truck at all times while the work platform, supported on the forks of the truck and from which an employee was laying concrete block approximately 17 feet to the ground.
