29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Genesio Co. - Two employees were installing HVAC units without any means of fall protection along the leading edge of a low sloped roof that was 10'6" above grade exposing employees to fall hazards on or about June 8, 2012. No abatement certification or documentation required.

29 CFR 1926.503(a)(2)(viii): The employer did not assure that each employee had been trained by a competent person qualified in the standards contained in subpart M. a) Genesio Co. - Two employees were installing HVAC units along the leading edge of a low sloped roof that was 10'6" above grade and were not trained by a competent person to recognize potential fall hazards and how to mitigate those hazards on or about June 8, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
