29 CFR 1926.451(e)(9)(i):     The employer did not provide safe means of access for each employee erecting or dismantling a scaffold:    a) On or about 06/21/2012, an employee was observed on a scaffold system at the construction of the Amenity Center of Waterset in Apollo Beach, Fl. The scaffold system lacked a safe means of access exposing the employee to a fall hazard of approximately 13 feet. A fall at this height could cause concussions, broken bones or death.

OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to a fall hazard while being lowered from a scaffold system on the forks of a rough terrain forklift that did not meet the ANSI/ITSDF B56.6-2011, Safety Standard for Rough terrain Forklift Trucks, section 5.15.1 Elevating Personnel:     a) On or about 06/21/2012, an employee was observed traveling on the forks of a GEHL RS6-42 Telescopic handler at the construction of the Amenity Center of Waterset in Apollo Beach, Fl. The employee was approximately at 13 feet above the ground was exposed to a serious fall hazard that could have caused concussions, broken bones and death.
