29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. On or about June 14, 2012, at the worksite located at 3101 North 1st Street in Jacksonville, Arkansas, the approximately 36 wide x 60 tall window opening, approximately 22 inches from the floor ground on the 2nd level of Building #1, was not guarded. This condition exposed employees to the hazard of falling through the window opening to an approximately 10 ft. fall from elevation.
