29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident. The employer did not orally report the death of an employee due to work-related events in the workplace. This violation occurred on June 13, 2012 at Advanced Drilling Systems, where the work-related death of an employee was not reported within 8 hours. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the death of an employee is orally reported to OSHA within 8 hours.
