29 CFR 1910.95(c)(1):     The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) In the boiler area, the boiler maintenance operator was exposed to continuous noise levels of 91.3 % of the allowable TWA of 66 % or 85 dBA. The equivalent dBA level for 91.3 % is 89.34. As observed on or about June 20, 2012.    b) In the Grinder Room, a grinder operator was exposed to continuous noise levels of 80.3 % of the allowable TWA of 66 % or 85 dBA. The equivaleent dBA level for 80.3 % is 88.41. As observed on or about June 20, 2012.    c) In the Grinder Room, a grinder operator was exposed to continuous noise levels of 78 % of the allowable TWA of 66 % or 85 dBA. The equivalent dBA level for 78 % is 88.2.

29 CFR 1910.147(c)(4)(i):     Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.     a) At the facility, employees enter the batch tanks for cleaning exposing employees to the hazard of entrapment by the agitator blades. No specific procedures have been developed for the control of hazardous energy. As observed on or about June 20, 2012.
