29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:         a) Backside of structure, exterior top plate: On June 21, 2012, and at times prior thereto an employee performed framing activities which included cutting tails while on the exterior top plate without a fall protection system in place.  The employees was exposed to an 11 foot fall hazard.       Note) Abatement certification is NOT required for this item.

29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Backside of structure:  On June 21, 2012 and employee working on the ground below another employee who was performing framing activities which included operating a hand saw to cut tails, was not protected by a hard hat.      Note) Abatement certification IS required for this item.
