29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed: (a)Child Development Center: Employees used a 6 foot Werner fiberglass step ladder to gain access to a low slope roof that was placed on a scaffold platform. The step ladder was in the closed position and leaned against the roof eave, and the ladder did not extend 3 feet above the upper landing surface being accessed, as observed on June 20, 2012. 29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: (a)Child Development Center: Employees were using a 6 foot Werner fiberglass step ladder that was closed and leaned against the eave of a low slope roof. The ladder was used to access the roof and the base of the step ladder was not fully opened and spreaders were not in the opened locked position, as observed on June 20, 2012. Abatement Note: One feasible and acceptable abatement method to correct this hazard is to select a ladder, such as an extension ladder placed on ground level, which extends three feet beyond the landing being accessed, and with both side rails firmly supported equally. Abatement Certification Required for this Item
