29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent:    This violation recently occurred on June 21, 2012, at 1710 Couch Drive, McKinney, TX; where a hearing conservation program was not developed when employees were exposed to noise:      a) An employee working as a molder operator was exposed to continuous noise levels at 175.7% of the permissible 8-hour time-weighted average sound level. The equivalent dBA level at 175.7% is approximately 94.9 dBA. The survey was conducted for 425 minutes during one shift on June 21, 2012. Zero exposure was assumed for the un-sampled period of 55 minutes.      b) An employee working as a molder helper was exposed to continuous noise levels at 102.3% of the permissible 8-hour  time-weighted average sound level. The equivalent dBA level at 102.3% is approximately 91.2 dBA. The survey was conducted for 415 minutes during one shift on June 21, 2012. Zero exposure was assumed for the un-sampled period of 65 minutes.

Each employer required by this Part to keep records of fatalities, injuries, and illnesses did not record each fatality, injury and illness that:      (1) Is work related; and      (2) Is a new case; and      (3) Meets one or more of the general recording criteria of 1904.7 or the application to specific cases of 1904.8 through 1904.12.    This violation occurred on June 12, 2012, at 1710 Couch Drive, McKinney, TX; job related injuries were not recorded on the OSHA 300 Log:         a) Molder operator on April 11, 2012 had a lost time injury.         b) Molder operator on June 5, 2012 had a lost time injury.
