29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     a. On or about June 13, 2012, on the 3rd level of the structure, an employee performing framing operations was not protected from the hazard of falling 23 feet to the surface by use of a guardrail system, safety net system, personal fall arrest system or any fall protection.     b. On or about June 13, 2012, on the 2nd level of the structure, an employee performing framing operations was not protected from a 11.8 feet fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any fall protection.

29 CFR 1926.1052(c)(4): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members, shall be provided between the top rail of the stairrail system and the stairway steps.    a. On or about June 13, 2012, employees used a stairway system that did not have a midrail system, screens or mesh establised, exposing the employees to a fall hazard.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder.     a. On or about June 13, 2012, employees used a 20 ft. Louisville extension ladder to access the 3rd level of the structure that did not extend 3 ft. above the floor landing, exposing themselves to a fall hazard.

29 CFR 1926.1053(b)(15): Ladders shall be inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use.    a. On or about June 13, 2012, a 20 ft. Louisville extension ladder used by employees was not inspected for defects in that the foot pads were not locked into place,exposing employees to a fall hazard.
