29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    The employer does not ensure each employee on a walking/working surface with an unprotected side or edge that is 6 feet or more above a lower level is protected from falling by the use of a guardrail system, safety net system or personal fall arrest system.      a) This violation was observed on or about June 20, 2012, on the south side of apartment building 7 where an employee was exposed to a fall hazard of more than 6 feet while conducting roofing activities without a fall protection system.     b) This violation was observed on or about June 20, 2012, on the north side of apartment building 6 where an employee was exposed to a fall hazard of more than 6 feet while conducting roofing activities without a fall protection system.    c) This violation was observed on or about June 20, 2012 on the west side of apartment building 6 where an employee was exposed to a fall hazard of more than 6 feet while conducting roofing activities without a fall protection system.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface, and the ladder length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    The employer does not ensure that when a portable ladder is used for access to an upper landing surface, the ladder side rails extend at least 3 feet above the upper landing surface to which the ladder is used to gain access.     a) This violation was observed on or about June 20, 2012, on the south side of apartment building 7 where an employee was exposed to a fall hazard while using an extension ladder to access the roof of the apartment without extending the ladder 3 feet beyond the landing of the roof.     b) This violation was observed on or about June 20, 2012, on the north side of apartment building 6 where an employee was exposed to a fall hazard while using an extension ladder to access the roof of the apartment building without extending the ladder 3 feet beyond the landing of the roof.
