29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: The employer does not protect employees from head injuries sustained by objects falling or flying off the scaffolding. This violation was observed on or about June 20, 2012, on the eastern face of the scaffold where employees were exposed to falling equipment and material while conducting masonry activities on and around the scaffold without wearing hardhats. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided protective helmets to guard against head injuries falling or flying objects.

29 CFR 1926.451(c)(3): Supported scaffold poles, legs, post, frames, and/or uprights were not plumb and braced to prevent swaying and displacement: The employer does not ensure that supported scaffold poles, legs, post, frames or uprights are braced. This violation was observed on or about June 20, 2012, on the eastern face of a tubular welded frame scaffold where employees were exposed to a fall hazard when constructing a masonry wall without cross bracing in each upper and lower sections of the scaffold. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all sections of the scaffolding are properly braced.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. The employer does not provide ladders for employees to safely access the scaffolding. This violation was observed on or about June 18, 2012, on the eastern face of the scaffold where employees were exposed to a fall hazard when accessing the 11'2" high scaffold without a ladder. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a safe means of access is provided for employees to safely access scaffolds.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. The employer does not protect employees from falling when working 10 feet or more above lower levels. This violation was observed on or about June 20, 2012, where employees constructing a masonry wall were exposed to a 11'2" foot fall hazard when working from a tubular welded frame scaffold where a guardrail or personal fall protection sytem were not not utilized. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a guardrail or personal fall arrest system is utilized.
