29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Arana, Rene at 6307 Huntly Rd., Timnath, CO 80547: On or before June 23, 2012, the employer did not ensure that employees were protected from falling in the following instances: 1) Two employees were sheathing a 9 in 12 pitch roof without the use of fall protection. Condition exposed the employees to fall hazards of 20' measured from ground to eave; 2) Four employees were exposed to fall hazards on a 6' long open landing from the second floor hallway to the first floor. Condition exposed employees to fall hazards of 10' measured from the second floor to the first floor; 3) Four employees were exposed to fall hazards on a 9.3' long open landing above the stairway used to access the second floor. Condition exposed employees to fall hazards of 7.6'' measured from the second floor to the steps; and 4) Four employees were exposed to fall hazards on a 9.3' long open landing above the stairway used to access the basement. Condition exposed employees to fall hazards of 7.6'' measured from the main floor to the steps.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches, whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge: a) Arana, Rene at 6307 Huntly Rd., Timnath, CO 80547: On or before June 23, 2012, the employer did not ensure that two stairways were equipped with at least one handrail and one stairrail system along each unprotected edge. The stairway going to the basement included 13 risers with a 7 9/16" rise and an 11" run, was 36" wide, and was open on the outside edge. The stairway going to the second floor included 13 risers with a 7 5/8" rise and an 11" run, was 40" wide, and 8 risers were open on the outside edge. Conditions exposed employees to fall hazards of up to 75" measured from the upper exposed step to the landing.

The saw was not double insulated, but was used with a ground fault circuit interrupter, in the interior of the house. Condition exposed employees to electrical shock hazards.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used: a) Arana, Rene at 6307 Huntly Rd., Timnath, CO 80547: On or before June 23, 2012, the employer provided a Skilsaw (Model H28925 serial number HG-406691), and this Skilsaw's electrical cord had damaged outer insulation. The saw was not double insulated, but was used with a ground fault circuit interrupter, in the interior of the house. Condition exposed employees to electrical shock hazards.
