OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazards: Three Employees were observed using a TranzSporter LH200 Platform Hoist as a ladder to access the roof of a residential house. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement is to read and understand the Operators Manual for this equipment and use an extension ladder to access the roof:    a) On or about 06/23/12 at 1410 Essex Avenue, Linden, NJ 07036 three employee were observed climbing a TranzSporter Platform Hoist as a ladder to access the roof of a residential house.

29 CFR 1926.102(a)(1):     29 CFR 1926.102(a)(1): Eye and face protective equipment was not used when machines or operations presented potential eye or face injury:     a) On or about 06/23/12 CSHO observed a man operating a Hitachi NV45AB2 pneumatic nail gun with no eye and or face protection in place, i.e. safety glasses and or face shield.

29 CFR 1926.501(b)(13):     29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:    a) On or about 06/23/12 CSHO observed three men working on and from a roof of a two story, single family residential home installing new roofing material with no fall protection systems in place.
