29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b).  Note:  If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.    (a) Rooftop - Roofers were observed putting down a new rooftop surface while working at its edge without using any fall protection.  The employees were exposed to a fall from elevation of approximately 23 feet to the ground below, on or about May 2, 2012.    (b) Rooftop  - Roofers were observed putting down a new rooftop surface while working around an unguarded roof hatch opening without using fall protection.  The employees were exposed to a fall from elevation of approximately 9 feet to the porch below, on or about May 2, 2012.

29 CFR 1926.1053(b)(1):  Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:      (a) Right Side of Building - Roofers were using a ladder to access their work area on the rooftop and it was only a foot above the upper landing surface, on or about May 2, 2012.
