29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed: (a)Storage/Tool Trailer: Employees used a 5 foot Lynn fiberglass step ladder to gain access to the elevated truck bed platform that was 4 foot 3 inches in height. The ladder did not extend 3 feet above the upper landing surface being accessed, as observed on June 19, 2012. Abatement Certification Required for this Item.

The step ladder was not used for which it was designed in that the, the legs of the step ladder were not opened and locked in place, as observed on June 19, 2012. Abatement Certification Required for this Item.
