29 CFR 1910.134(d)(1)(i): The employer shall select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker is exposed and workplace and user factors that affect respirator performance and reliability. 29 CFR 1910.134(d)(1): Employees removing Lead-based paint with powered tools wore respiratory protection that was iinappropriate and ineffective against Lead-contaminated dust. The employees used cloths and rags wrapped around their faces and necks in an attempt to prevent contamination inhalation.

29 CFR 1910.134(h)(1)(i): Respirators issued for the exclusive use of an employee shall be cleaned and disinfected as often as necessary to be maintained in a sanitary condition: Worksite: Half-mask elastomeric respirators kept by the employer to be used by employees as protection against Lead-contaminated dust, were not regularly cleaned and maintained in a sanitary manner. The respirators were kept in the employer's work truck and were contaminated with dirt, dust, and heavy accumulations of paint residue.
